South Africa’s govt keeping nuclear costs secret from the public

The reports were commissioned in the past year by the department from KPMG, Ingerop and Deloitte to provide information on nuclear-procurement models, the cost of nuclear plants and financing models.

The Open Democracy Advice Centre requested the documents on behalf of Business Day under the Promotion of Access to Information Act last month.

In a reply received this week, deputy director-general of the department Zizamele Mbambo said “the records contain information to be used in the procurement process. The disclosure of such information will compromise the negotiations or prejudice the commercial competition as far as third parties are concerned”.

These were the same grounds used to maintain the secrecy of the intergovernmental agreements on nuclear co-operation. But when the agreements were tabled in Parliament in June, they contained no proprietary or commercial information. The letter also states that the documents are classified. Mr Mbambo has said the department’s studies show that the nuclear build “is affordable” without giving details.

Business Day editor Songezo Zibi said the application was made as “we have reason to believe that the cost studies the department does not want the public to see until it is too late in the process, show that 9,600MW of nuclear will be unaffordable”.

The Open Democracy Advice Centre is to appeal against the refusal.

Spokesman for the Right 2 Know Campaign Murray Hunter said the affordability study for SA’s strategic arms procurement in 1999 was classified until last year. “When this was unclassified, it was clear that there had been enormous financial risks. Governments often overclassify documents to shield themselves from accountability and end up making the wrong decisions. The fact that these documents are being withheld makes it impossible for SA to have the conversation about nuclear energy.”

Energy Minister Tina Joemat-Pettersson recently claimed that she had never advocated nuclear build of 9,600MW.

Mr Zibi said it “was also curious how a cost study can be conducted if, as the minister claimed, the size of the procurement was yet to be determined. What, then, would be the benchmark number if not the 9,600MW already mentioned by the president and ministers of energy including Ms Joemat-Pettersson?”

 SNC-Lavalin Inc. announced this morning it has replaced president and CEO Bob Card with Neil Bruce, and told CBC News the move is “completely unrelated” to new allegations, published today, in a civil suit that claims giving bribes to win contracts was part of the past practices of the company.The Montreal-based engineering firm, which Card took over in the spring of 2012 to clean up past issues, faced new allegations Monday from a former executive who claims the company has made him a “scapegoat,” and alleges other top executives for years endorsed bribes and lavish gifts — including a yacht and even prostitutes — to win contracts from Libya’s Gadhafi regime.The serious allegations by Riadh Ben Aïssa, SNC’s former executive vice-president of construction, are contained in a newly filed court pleading as he defends himself against one of a number of civil lawsuits by the company, which itself is facing criminal charges of foreign corruption.

Ben Aïssa sets out a long list of SNC contracts in Libya, worth billions, that arose from the partnership and that he alleges were won through kickbacks paid to side agents.

“Most of SNC’s senior executives knew that the so-called agency contracts were in reality bribes paid to Libyan foreign officials in exchange for the award of the sole-source contract,” the former construction executive alleges.

What’s more, Ben Aïssa declares the money was “fraudulently charged back” to the Libyan government by embedding the costs in the project before SNC submitted its offers.

How Charles Koch operates to sabotage renewable energy development

Charles Koch responded saying he was “flabbergasted” after hearing Obama’s remark. He continued, “We are not trying to prevent new clean energy businesses from succeeding.” This statement is, at best, highly misleading.

Charles Koch states that he believes government should be smaller and it should not subsidize businesses, including any form of energy business. But while he acknowledges that the fossil fuel businesses he owns benefit tremendously from government subsidies, he doesn’t refuse those benefits or do anything to stop those policy choices.  Meanwhile, the Kochs use their political influence and funding for efforts to repeal laws designed to support the deployment of more renewable electricity. Specifically, their political network’s agenda includes weakening renewable energy standards, preventing customers from installing solar panels (by charging fees on people that go solar), and protecting the government monopolized electric utilities.

The facts are indisputable.

Here are the facts:

  • Arizona Public Service Company (APS), the largest electric utility company in Arizona, admitted that it worked with the 60 Plus Association, a Virginia-based nonprofit seniors advocacy group receiving Koch money, to support the utility company’s proposal to add fees on homeowners with solar panels. Here is anadvertisement paid for by 60 Plus Association attacking solar energy in Arizona.
  • 60 Plus Association is now working with the utility companies in Florida to preserve the status quo and the state’s outdated business model, and prevent customers from purchasing electricity from third party solar companies.
  • Americans For Prosperity has also worked in Kansas and North Carolina to repeal, weaken, or freeze those states renewable energy standards. In 2013, AFP flew Willie Soon to Kansas where he testified in front of state legislators that global warming isn’t a problem as part of AFP’s attempt to completely repeal the renewable energy standard. James Taylor, from the ExxonMobil and Koch-funded Heartland Institute, attended an AFP event the same year to increase support for repealing the state’s standard, and he also testified against the law. Furthermore, Koch Industries’ lobbyist Jonathan Small worked behind the scenes in the repeal efforts. Small held private talks with Representative Dennis Hedke (R-Wichita) about legislation to eliminate the law. In 2015, the standard waschanged to a voluntary one after legislators threatened to impose an excise tax on wind energy. Mike Morgan, a lobbyist for Koch Industries, joined Rep. Hedke and Jeff Glendenning of AFP at the announcement.
  • Additionally, Koch-controlled foundations approved grants for Art Hall, director of the University of Kansas’ Center for Applied Economics, to research the state’s renewable energy standard. Lee Fang at The Intercept writes, “The Koch money was part of an ongoing project Hall described as an effort to develop “intellectual products” to be used “as a tool in economic policy debates… Following his grant request, Hall testified before the Kansas legislature in 2014 in favor of repealing the state renewable energy portfolio.”

Many social sciences and humanities faculties in Japan are to close after universities were ordered to “serve areas that better meet society’s needs”.

Of the 60 national universities that offer courses in these disciplines, 26 have confirmed that they will either close or scale back their relevant faculties at the behest of Japan’s government.

It follows a letter from education minister Hakuban Shimomura sent to all of Japan’s 86 national universities, which called on them to take “active steps to abolish [social science and humanities] organisations or to convert them to serve areas that better meet society’s needs”.

The ministerial decree has been denounced by one university president as “anti-intellectual”, while the universities of Tokyo and Kyoto, regarded as the country’s most prestigious, have said that they will not comply with the request.

However, 17 national universities will stop recruiting students to humanities and social science courses – including law and economics, according to a survey of university presidents by The Yomiuri Shimbun newspaper, which was reported by the blog Social Science Space.

It reports that the Science Council of Japan put out a statement late last month that expressed its “profound concern over the potentially grave impact that such an administrative directive implies for the future of the HSS [humanities and social sciences] in Japan.

The call to close the liberal arts and social science faculties are believed to be part of wider efforts by prime minister Shinzo Abe to promote what he has called “more practical vocational education that better anticipates the needs of society”.

However, it is likely to be connected with ongoing financial pressures on Japanese universities, linked to a low birth rate and falling numbers of students, which have led to many institutions running at less than 50 per cent of capacity.

Sister Megan Rice, Michael Walli and Greg Boertje-Obed were originally convicted of felony sabotage for their 2012 actions in Oak Ridge, Tennessee, where they cut through fences and sneaked into the most secure area of the Y-12 National Security Complex. Once there, they hung banners, prayed and hammered on the outside wall of the bunker to symbolize a Bible passage that refers to the end of all war: “They will beat their swords into ploughshares.”

Rice was sentenced to nearly three years in prison while Walli, 66, and Boertje-Obed, 60, were each sentenced to just over five years. The 6th U.S. Circuit Court of Appeals threw out the sabotage charge in May, leaving a conviction on the lesser charge of injuring government property. When they were released from prison in June, the anti-nuclear activists had already served two years.

Government prosecutors had asked U.S. District Judge Amul Thapar to put the activists on supervised released.

Defense attorney Judy Kwan said the judge on Tuesday ordered two years of unsupervised release instead. During that time the activists are prohibited from going onto the grounds of any nuclear facilities.

The activists asked the judge to reduce the amount of restitution they were ordered to pay for damage at Y-12, nearly $53,000. He denied that request, Kwan said.

Rice and Walli, who live in Washington, D.C., and Boertje-Obed, who lives in Minnesota, are part of a loose network of activists who oppose the spread of nuclear weapons through provocative non-violent protests they call ploughshares actions. In the aftermath of their break-in at Y-12, federal officials implemented sweeping changes, including new management and a new defense security chief to oversee all of the National Nuclear Security Administration’s sites.

 The US Nuclear Regulatory Commission is considering a move to eliminate the ‘Linear No-Threshold’ (LNT) basis of radiation protection that the US has used for decades and replace it with the ‘radiation hormesis’ theory – which holds that low doses of radioactivity are good for people……..

If only radiation wasn’t dangerous, nuclear power would be so easy .

In the wake of the Manhattan Project, the US crash program during World War II to build atomic bombs and the spin-offs of that program – led by nuclear power plants – there was a belief, for a time, that there was a certain ‘threshold’ below which radioactivity wasn’t dangerous.

But as the years went by it became clear there was no threshold – that any amount of radiation could injure and kill, that there was no ‘safe’ dose. Low levels of radioactivity didn’t cause people to immediately sicken or die. But, it was found, after a ‘latency’ or ‘incubation’ period of several years, the exposure could then result in illness and death.

Thus, starting in the 1950s, the ‘Linear No-Threshold’ standard was adopted by the governments of the US and other countries and international agencies.

It holds that radioactivity causes health damage – in particular cancer – directly proportional to dose, and that there is no ‘threshold’. Moreover, because the effects of radiation are cumulative, the sum of several small exposures are considered to have the same effect as one larger exposure, something called ‘response linearity’.

Nuclear whistleblower Mordechai Vanunu again under house arrest in Israel

More than a decade since completing his 18-year jail-term for exposing details of Israel’s nuclear weapons, Mordechai Vanunu has been put under house arrest. His detention follows a TV interview regarding the disclosure. 
Army radio reported on Thursday that Vanunu had been arrested in the early hours of September 5, hours after privately owned Channel 2 broadcast an interview which authorities said violated the terms of his 2004 release.

The 60-year-old reportedly appeared in a Jerusalem court before he was confined to his home for seven days. The court also imposed a ban on Vanunu using the Internet.

A senior Israeli security official later confirmed Vanunu’s detention, telling DPA news agency that he was forbidden from sharing any classified information which he learned while working at the Israeli nuclear plant in Dimona, “even if he already published that information in the past.”

Vanunu was first imprisoned in 1986 for exposing details behind Israel’s nuclear weapons plan to British newspaper “The Sunday Times.”

He spent more than 10 years of his sentence in solitary confinement.

In 2010, Vanunu was imprisoned for a second time after a court ruled that he had broken the terms of his release by talking to a foreigner……

Police have demanded to see last week’s interview in its entirety. Channel 2 has refused to hand over the unedited footage, however, on the grounds of the journalistic principle of the protection of sources. The television station is now taking the case to court.

Israel has neither confirmed nor denied that it owns nuclear weapons – the only Middle East country to do so.

South Australia’s Nuclear Fuel Chain Royal Commission – conflict of interest revealed.

I’m a private citizen and have no vested interest in the nuclear industry; however the nuclear industry does direct ly impact me, my family and my friends As a member of the public I wish to give evidence and express my concerns in regard to the issues being examined by the Royal Commission.

It is valid to examine economics and risks relating to the nuclear industry; however is the Royal Commission a fair and objective examination of the Nuclear Cycle? It has been disclosed that Kevin Scarce Is a shareholder in the Rio Tinto Group,who own and operate Scarce,--Kevin-glowuranium mines in Australia and internationally. ls this a conflict of interest for the Royal Commissioner? It is of great concern that the Royal Commissioner has selected predominantly pro-nuclear experts for the R.C’s Advisory Committee (the single exception being Professor lan Lowe). See Appendix 1.

It also seems remiss that there isn’t any health or medical professionals engaged in the R.C’s Expert Advisory Committee or Key Commission staff. It’s well documented that by-products of the nuclear industry can have adverse effects on the health of the global community for many future generations. The omission of health experts makes me question whether the R.C is truly considering what is in my and the general public’s best interest.

The Public Health Association of Australia have made their position clear in regard to the R.C and the Nuclear Industry, see http :1 /www .phaa. net. au/ documents/item/51 0 or http://www .phaa.net.au/documents/item/264  The Royal Commission could prove to be pivotal in South Australia’s future having significant and far reaching consequences, affecting many future generations; however, was the process leading toward the establishment the Royal Commission flawed?

Appendix. 1 4 of the 5 Royal Commissions Expert Advisory Committee appear to be pro nuclear. They are Professor Barry Brook, Dr Timothy Stone, John Carlson AM and Dr Leanna Read. Below is a brief summary oftheir involvement in the nuclear industry Professor Barry Brook is an active advocate of the Nuclear Industry. The self described”Promethean Environmentalist” is openly critical of people who have concerns regarding the Industry. Professor Brook is the author of, or contributor to several pro nuclear publications such as; Key role for nuclear energy in global biodiversity conservation, Australia’s nuclear options and, An Open Letter to Environmentalists on Nuclear Energy. To name a few.

Dr Timothy Stone is an advocate for nuclear power generation and nuclear industrial expansion in Australia. In the UK Dr Stone has held the position of Expert Chair ofthe Office for Nuclear Development and he is currently on the board of Horizon Nuclear Power as non-executive Director John Carlson AM has been Director General of the Australian Safeguards and Non-Proliferation Office. In part 6 of the introduction to Mr Carlson’s paper “Nuclear power for Australia”- an outline of the key issues he claims “Nuclear has a major advantage over other energy sources”. Later in the same document Mr Carlson states “Currently both major parties say that nuclear power is “offlimits”. While this is disappointing, at least it ensures neither side is making statements tlhat will later be embarrassing to retract” It is clear that Mr Carlson is pro nuclear providing the appropriate safeguards are met

Dr Leanna Read has publicly stated that she “has an open mind” regarding the Nuclear Industry. Dr Read is a Fellow of the Australian Academy ofTechnological Sciences and Engineering, which advocated for nuclear power in Australia in August 2014. This seems to contradict Dr Read’s claims of impartiality toward the nuclear industry Given the information in Appendix 1, can the Royal Commission be considered truly independent?

  • Question: 1. Even with best practice and best intentions, industrial accidents happen. What infrastructure is currently in place, should a truck loaded with uranium oxide be involved in an accident in the Metropolitan area and whilst doing so, have a breach of its load or catch fire?
  • Question: 2. Is it possible to insure against a nuclear mishap and how is Public Liability insurance affected in an accident scenario?
  • Question: 3.Many environmentalists believe that The Roxby Downs Indenture Act 1982 al lows wide ranging exemptions from key environmental laws such as the SA Environmental Protection Act 1993, Freedom of information Act 1991 and the Natural Resources Act 2004 critical water resources and Great Artesian Basin. Is this true?
  • Question: 4. If the answer to question 3 is true, please explain how these exemptions are in the public interest?
  • Question: 5.1s it possible that similar exemptions will be extended to waste dumps, uranium enrichment operations or nuclear power stations?
  • Question: 6. Recent revelations by the EPA {Environmental Protection Agency) reveal widespread and irreversible groundwater contamination by industrial practices in several of Adelaide’s suburbs. Wouldn’t it be prudent for the Commissions terms of reference to contain a review of current uranium mining and transport practices?
  • Question: 7. Would it be sensible to hold a review of the current condition of waterways and aquifers affected by mining practices before an expansion of SA’s nuclear industry commences?
  • Question: 8. Since the proposed expansion of Olympic Dam a few years ago, has the SA public been receiving fair and balanced media coverage on the nuclear Industry,  particularly in printed media?
  • Question: 9. What has been the ratio of Pro/Con nuclear industry stories and editorials in the Advertiser Newspaper since 201 0?
  • Question: 10. What influence has this ratio had on the general public’s current view towards the nuclear industry?
  • Question: 11. Will the commission call on medical and health specialists to give their perspectives on the nuclear industry and its impact on workers within the industry and the wider community?
  • Question: 12. Can Nuclear Energy really be defined as a low carbon emission energy source when millions of litres of Diesel are consumed in the Nuclear Cycle annually, particularly in the mining and transport of uranium oxide?
  • Question: 13. Uranium waste products can take hundreds of thousands of years to halve their level of toxicity. Pyramids are amongst the oldest surviving manmade structures and are no more than 5000 years old. Therefore what assurances are there, that nuclear waste can be safely stored over much longer periods oftime?
  • Question 14.1f South Australia is perceived to be a nuclear waste site by the global community, what will the impact be on Tourism, Real Estate, Food, Wine and manufacturing industries be?
  • Question 15.Highly toxic Radon gas is released by the mining activities at Roxby downs and apparently can be detected in Antarctica. This gas must pass through Adelaide to get there. What is the effect of Radon gas to workers in the mines and what impact does it have on the wider community?
  • Question: 16. What is the volume of airborne radioactive dust released into atmosphere by mining and storage of tailings exposed to the wind?
  • Question: 17.What impact does radioactive dust released by mining practices, have on the Australian public, fauna and flora?
  • Question: 18.Presumably nuclear waste will be transported from Port Adelaide to its storage destination. What would be the outcome, in the advent of an accident, or fire to the transport within the M etropolitan area?
  • Question: 19. 33.6 percent of Australian uranium is exported to North America. The US military has depleted uranium coated ammunitions and armaments, such as bullets and tank shielding. There have been reports claiming an alarming rise of birth defects to children of returned US soldiers and civilians occupying militarised zones. These reports claim the birth defects can be attributed to use of depleted uranium coated ordnance. What checks are in place to guarantee no Australian uranium or its by-products is used to coat US military
  • Question: 20. Has uranium coated ordinance or tank shielding been used by the United States Army in war games in central Australia?
  • Question: 21. Prior to his selection as “Chair of the Royal Commission” Kevin Scarce had aligned himself with CEDA (the Committee for Economic Development In Australia). CEDA’s Policy Perspectives of Nov 2011 clearly supports and promotes the growth of South Australia’s nuclear industry. Is this a conflict of interest for the Royal Commissioner?
  • Question: 22.There are cl ips on You T ube(see Aug 12th 2014) where Kevin Scarce confirms his association with CEDA, using terms like “we were able to get our draft report considered by government. ” Given his connection with CEDA and their pro nuclear stance, is Kevin Scarce truly impartial and unbiased in regard to South Australia’s nuclear issues?

TIMES OF ISRAEL,   BY DAVID HOROVITZ September 4, 2015  In a remarkable departure from decades of nuclear secrecy, Israel’s military censors permitted nuclear spy Mordechai Vanunu to give a lengthy interview to primetime Israeli television on Friday night, in a move that took Israel closer than ever to acknowledging the existence of its nuclear arsenal..

The interview on Israel’s Channel 2 news featured several fascinating revelations and anecdotes, but its most dramatic aspect by far was that Vanunu — who was barred from giving interviews under the terms of his release from 18 years in jail for treason in 2004 — was allowed to speak freely, with the full permission of Israel’s security establishment, about what his interviewer rightly termed his exposure of “one of Israel’s greatest secrets.”

A technician from 1976-85 at Israel’s nuclear facility at Dimona, Vanunu revealed overwhelming evidence of Israel’s nuclear program to Britain’s Sunday Times in 1986, including dozens of photographs, enabling nuclear experts to conclude that Israel had produced at least 100 nuclear warheads.

To this day, Israel has never acknowledged that it has a nuclear arsenal, instead maintaining a policy of “nuclear ambiguity” while vowing that it will not be the first to use nuclear weapons in the Middle East.

The timing of the interview Friday appeared particularly telling, as Israel internalizes that its lobbying efforts have likely failed to prevent Congress approving the world powers’ nuclear deal with Iran, which Prime Minister Benjamin Netanyahu has called “a historic mistake.” Netanyahu has repeatedly pledged to act alone if necessary to ensure Iran does not obtain nuclear weapons. Two weeks ago, the military censor allowed the broadcast on TV of tape-recorded conversations in which former defense minister Ehud Barak describes at least three occasions in 2010, 2011 and 2012 when Israel ostensibly came close to striking at Iran’s nuclear facilities……..

Israel has repeatedly denied him permission to leave the country, in part because he allegedly still constitutes a security threat, and a further High Court hearing on the issue is expected soon. (In 2007, Vanunu was jailed for an additional six months for violating his release provisions when he was found traveling towards the West Bank city of Bethlehem, away from his home in Jerusalem.)

Vanunu also claimed he was punished more severely because he comes from a poor Moroccan background as opposed to a more privileged European one. Former head of Brazil’s nuclear company will face trial

Judge accepts charges filed against former head of Brazil nuclear power firm Fox News, 3 Sept 15 SAO PAULO –  A federal judge Thursday accepted the charges filed by prosecutors against the former head of Eletronuclear, the state-owned company that operates Brazil’s two nuclear power plants, for his suspected role in a bribery scandal.

Othon Luiz Pinheiro da Silva will face trial for allegedly taking 4.5 million reals ($1.22 million) in bribes from construction companies for contracts involving the construction of the Angra 3 nuclear plant in Rio de Janeiro.

Exposed: confidential agreement gives Russia unfair control over South Africa’s #nuclear project

The text, which has been jealously guarded by her department and Russian nuclear company Rosatom, holds many dangers for South Africa.

It creates an expectation that Russian technology will be used for South Africa’s trillion-rand fleet of new nuclear power stations. And by laying the groundwork for government-to-government contracting, it appears designed to sidestep the constitutional requirement for open and competitive tendering.

Once the agreement comes into force, the Russians will have a veto over South Africa doing business with any other nuclear vendor. And it will be binding for a minimum of 20 years, during which Russia can hold a gun to South Africa’s head, in effect saying: “Do business with us, or forget nuclear.”

The agreement confirms the government’s intention to make “Atomic Tina’s” energy department the procuring agent for the nuclear programme rather than Eskom – where the country’s nuclear expertise lies, despite the utility’s travails. Joemat-Pettersson signed the agreement in Vienna on September 21 last year, three weeks after President Jacob Zuma held talks with his Russian counterpart, Vladimir Putin, at the latter’s country estate.

The terms of the agreement lean heavily in Russia’s favour. They:

  • Indemnify the Russians from any liability arising from nuclear accidents during the reactors’ life. The agreement says South Africa is “solely responsible for any damage both within and outside the territory of the Republic of South Africa”;
  • Hand the Russians a host of regulatory concessions and “special favourable treatment” in tax and other financial matters, but offer South Africa no such incentives; and
  • Require Russia’s permission if South Africa wants to export nuclear technology it develops locally as a result of learning from the Russians, thereby hindering government’s aim that the nuclear new-build programme will develop a globally competitive local nuclear industry.

David Unterhalter, a University of Cape Town law professor and constitutional expert, this week said the agreement appeared to go far beyond the type of general framework document that government officials have declared it to be………

How we got the secret documentThe supposedly confidential agreement is published among the list of bilateral treaties on the website of the legal department of the Russian foreign ministry.

It was first obtained by South African environmental organisation Earthlife Africa Johannesburg by Russian anti-nuclear activist and head of Ecodefense Vladimir Slivyak, who got it from a source in the Russian foreign ministry. It is in Russian, and includes the signatures of Rosatom’s director general Sergey Kirienko and South African energy minister Tina Joemat-Pettersson.

A Russian translator commissioned by Earthlife to translate the agreement into English subsequently also found it publicly available on the ministry’s website.

Police asks prosecutors to charge former head of Brazil’s nuclear power on corruption

A federal police spokesman who was not authorized to be quoted by name said late Thursday that the department wants prosecutors to charge Othon Luiz Pinheiro da Silva with money laundering and corruption for allegedly taking as much as $10 million in bribes from construction companies for contracts involving the construction of the Angra 3 nuclear plant in Rio de Janeiro.

Da Silva was taken into custody in late July and one week later stepped down as Eletronuclear’s chief executive officer.

The spokesman said the department also wants charges filed against Flavio David Barra, the top energy executive at construction firm Andrade Gutierrez and da Silva’s daughter Ana Cristina Toniolo for their suspected roles in the scheme. Da Silva, his daughter and Barra have denied any wrongdoing.

During Brazil’s military regime from 1964-1985, the retired navy admiral and nuclear engineer headed Brazil’s secret program to master the technology needed to transform uranium into fuel to generate electric power in nuclear plants. Da Silva also oversaw the ongoing project to build a nuclear powered submarine.

The request for charges to be filed come as police and prosecutors try to determine whether a kickback scheme engulfing state-run oil company Petrobras extends to other state firms, including electric utilities company Eletrobras, of which Eletronuclear is a subsidiary.

Prosecutors have said the scheme involved roughly $2 billion in bribes and other illegal funds. Some of that money was allegedly funneled back to the ruling Workers’ Party and its allies’ campaign coffers. It also allegedly included the payment of bribes to Petrobras executives in return for inflated contracts.

For Alexandre Barros, a political risk consultant with the Brasilia-based firm Early Warning, the Eletronuclear case shows that Petrobras-like corruption and kickback schemes are “probably present in other state-run companies.”

“Schemes like these have long been part of our culture and I think other similar schemes start emerging all over the place”, Barros said  “My big fear is that the armed forces may start feeling uneasy,” he added, without elaborating.

Has SNC-Lavalin fouled up again? Literally

The plumbing problems are the latest in a series of glitches — as many as 14,000 — that continue to plague the $1.3-billion superhospital of the McGill University Health Centre, and are sorely testing relations between the MUHC and design-build contractor SNC-Lavalin.

The superhospital was built as a public-private partnership, with the Quebec engineering firm acting as the lead partner in a private consortium that is the landlord of the property. Unlike the Old Montreal Children’s where the MUHC could do what it wanted with the building as the sole owner, SNC-Lavalin is responsible for maintaining the superhospital and fixing plumbing, electrical and other problems.

But the MUHC has been at loggerheads with SNC-Lavalin over a wide range of “deficiencies” — from faulty wiring to leaking ceilings — since before the superhospital opened at the Glen site in the spring. The public-private partnership was supposed to transfer the risk of any cost overruns from the public sector to the private partner, but SNC-Lavalin is nonetheless seeking more than $172 million in “extras” from the MUHC over the construction……..
SNC-Lavalin won the contract in 2010 to build the MUHC superhospital after a competition with a Spanish-led consortium. Aug. 28 2015  Emails and financial documents released by the University of Kansas on Thursday reveal earmarked funding from Koch Industries to develop research used to lobby against the state renewable energy standard.

On November 12, 2013, Art Hall, the director of the university’s Center for Applied Economics, emailed Koch Industries’ Laura Hands to discuss a grant from a Koch-controlled foundation to fund research on the Renewable Portfolio Standard.

Hall is the former chief economist for Koch Companies Public Sector, the lobbying subsidiary of Koch Industries, the largest privately owned company in America with a significant stake in oil refining, pipelines, gas production and coal. Hands is the current community affairs director at Koch Companies Public Sector.

The Koch money was part of an ongoing project Hall described as an effort to develop “intellectual products” to be used “as a tool in economic policy debates.” Hall’s center also provides special classes to teach about the virtues of capitalism. Koch-controlled foundations approved $40,000 for work that included the renewable energy standard, as well as at least $250,000 to the center in 2008 and $100,000 to the center in 2009.

Following his grant request, Hall testified before the Kansas legislature in 2014 in favor of repealing the state renewable energy portfolio, which calls for major utility companies to use an increasing ratio of renewable energy such as wind and solar.

The emails and financial documents were released in response to a Kansas Open Records Act request filed by KU student Schuyler Kraus, the president of Students for a Sustainable Future.

Hall also helped craft unprecedented tax cuts signed into law by Gov. Sam Brownback, R-Kan., and backed by Koch’s local political network. The tax cuts have been viewed roundly as a historic flop, resulting in a downgrade of the state bond rating and drastic education cuts that forced public schools to close early this year. Critics argue that the tax cut and ensuing budget chaos may have hurt employment as bordering states such as Missouri are quicklyoutpacing Kansas on job growth.

President Barack Obama recently criticized Koch Industries owners Charles and David Koch, scolding the billionaires for “pushing for new laws to roll back renewable energy standards.” In response, Charles Koch said he is opposed to “crony capitalism” in all forms.

– Once a jewel of the Quebec business establishment, SNC-Lavalin Group Inc. now stands criminally accused of fraud and corruption after the RCMP announced charges against the engineering giant Thursday.

The case against SNC and two of its subsidiaries stems from the company’s dealings in Libya between 2001 and 2011, when a senior executive established close ties with Saadi Gaddafi, son of dictator Muammar Gaddafi.

Court documents allege the company offered bribes worth $47.7 million “to one or several public officials of the ‘Great Socialist People’s Libyan Arab Jamahiriya,’” as Gaddafi called the nation he ruled until he was overthrown and killed in 2011.

SNC and its subsidiaries SNC-Lavalin Construction Inc. and SNC-Lavalin International Inc. are also alleged to have defrauded various Libyan public agencies of approximately $129.8 million.

“Corruption of foreign officials undermines good governance and sustainable economic development,” RCMP Assistant Commissioner Gilles Michaud said Thursday. “The charges laid today demonstrate how the RCMP continues to support Canada’s international commitments and safeguard its integrity and reputation.”

For SNC, the charges represent another black cloud in a storm the company has been trying to escape since a tip from Swiss authorities triggered the RCMP investigation, dubbed Project Assistance, in 2011……..

The RCMP investigation has already led to charges against former SNC executives Sami Bebawi and Stéphane Roy as well as Mr. Bebawi’s lawyer, Constantine Kyres. Riadh Ben Aissa, a former SNC vice-president, pleaded guilty in Switzerland last year to charges of corruption and money laundering related to SNC’s Libyan business. He has been extradited to Canada where he is facing fraud charges related to the awarding of the McGill University Health Centre contract to SNC. Former SNC CEO Pierre Duhaime is facing similar charges in connection with the MUHC project.

The charges, filed Thursday in Montreal, do not specify who received the bribes, but a previously released RCMP affidavit, containing unproven allegations, described Saadi Gaddafi as a major recipient of SNC’s largesse.

“Riadh Ben Aissa’s close relationship with Saadi Gaddafi was a major asset to SNC-Lavalin who was well aware of it and fostered the relationship,” the affidavit sworn in 2013 by Cpl. Alexandre Beaulieu said………

n Quebec, there was concern Thursday about the impact the new charges will have on a major economic player. The Federation of Quebec Chambers of Commerce issued a statement saying the charges cannot be allowed to harm SNC’s business. “We have to stop collectively knocking ourselves down and move to a reconstruction phase,” the federation said.

Karl Moore, a professor at McGill University’s Desautels Faculty of Management, said the charges come at a bad time for SNC. “They’ve actually really changed,” he said. “They’ve changed the culture and it’s squeaky clean. It’s one of the best engineering firms, from a compliance point of view, in the world.”

He does not think the company’s survival is at stake, but it will suffer. “This puts a bit of a cloud on them. When they’re out there seeing clients, there is some concern, and competitors will bring it up,” he said. “If I’m a competitor of SNC, I would take considerable delight in pointing out [its] weaknesses.”
