Nuclear Regulatory Commission: obfuscation when it comes to Freedom of Information

see-no-evilNRC management of FOIA requests puzzling experts, Enformable,  Lucas W Hixson 16 Dec 15 Many people know of my interest in the release of information through the Freedom of Information Act by the Nuclear Regulatory Commission.

In October 2014, I participated in a meeting with Dave Lochbaum of Union of Concerned Scientists, Lawrence Criscione (who works for the Nuclear Regulatory Commission, but was participating in the meeting as a private citizen), Tim Judson of Nuclear Information Research Service, Jim Riccio of Greenpeace, Paul Gunter of Beyond Nuclear and the NRC Staff.  During that meeting each of the participants presented their concerns with how the NRC was interpreting certain FOIA rules.  My particular concerns that I presented at that meeting pertained to documents released relating to the Fukushima Daiichi nuclear disaster.

After that meeting, a group of participants (Lochbaum (Chairman), Judson, Riccio, Gunter, and Hixson) determined to form an official committee to interface with the Nuclear Regulatory Commission on FOIA-related activities.  That is how in December of 2014 the Freedom of Information Team (FIT) came into being……..

Tateiwa was in Tokyo in the early days of the Fukushima Daiichi nuclear disaster, translating TEPCO press releases from Japanese to English, meeting with the EU delegation and the NRC.  He was also present at a very important meeting on March 27th in Tokyo between NISA, INPO, and the NRC.  He participated in the IAEA Preliminary Fact-Finding visit to the Fukushima Daiichi plant in April 2011 and May 2011.  In June 2011 he was at the private residence of U.S. Ambassador Roos trying to reinforce ties, and in August he was aiding the INPO-led support team at Fukushima Daiichi.  By September 2011, Tateiwa was transferred to the TEPCO office in Washington D.C.

I felt that there was much that the public could learn and benefit from a better understanding of what Tateiwa knew and when and what he relayed to the NRC and when, so I asked Mr. Lochbaum to FOIA for all communication and materials transmitted between Mr. Tateiwa and any member of the NRC.

Dave Lochbaum submitted a FOIA request on Wednesday, August 5th, 2015 at 10:36:17 A.M. for “All materials transmitted between Mr. Kenji Tateiwa and the NRC from March 1, 2011, to date. Also, all written communications (e.g., emails, memos, letters, reports) between Mr. Kenji Tateiwa and the NRC from March 1, 2011, to date. By letter dated April 23, 2015 (ML15113B323), the ACRS Chairman conveyed appreciation to TEPCO, Mr. Tateiwa’s employer, for his appearance before the ACRS on April 10, 2015. The ACRS chairman stated that Mr. Tateiwa had “unique insights” and had great “familiarity with the Fukushima Daiichi issues.” UCS is aware that Mr. Tateiwa has had extensive experience with the Fukushima response and cleanup and seeks more of his “unique insights.””

No response was ever received from the NRC…….

Clearly, previous FOIA requests by other organizations and individuals encompassed emails and should’ve included Tateiwa’s records, but when Dave searched the NRC ADAMS database, he could only find ten records – six of them being FOIA responses.

Dave requested that the NRC not limit the scope of the FOIA request and to make all documents requested available.  This morning he also sent an email to Hubert Bell, Inspector General of the NRC, asking him to look into potential NRC staff wrongdoing by not releasing some, if not all, of these records in response to prior FOIA requests.

Mr. Lochbaum’s concerns are that either the NRC program office is lying now about the inventory of unreleased records to/from Mr. Tateiwa in their possession, or that the NRC violated federal FOIA law by failing to release some or all of these records in response to numerous prior FOIA requests.

The Subarnarekha River roars out of the Chota Nagpur plateau in eastern India, before emptying 245 miles downstream into the Bay of Bengal, making it a vital source of life, and lately, of death…..
Its link to widespread misfortune is not admitted by the Indian government. But the authorities’ role in the deaths of those who live near it first became clear when professor Dipak Ghosh, a respected Indian physicist and dean of the Faculty of Science at Jadavpur University in Kolkata decided to chase down a rural “myth” among the farmers along its banks. They had long complained that the Subarnarekha was poisoned, and said their communities suffered from tortuous health problems.

When Ghosh’s team seven years ago collected samples from the river and also from adjacent wells, he was alarmed by the results. The water was adulterated with radioactive alpha particles that cannot be absorbed through the skin or clothes, but if ingested cause 1,000 times more damage than other types of radiation. In some places, the levels were 160 percent higher than safe limits set by the World Health Organization.

“It was potentially catastrophic,” Ghosh said in a recent interview. Millions of people along the waterway were potentially exposed.

What the professor’s team uncovered was hard evidence of the toxic footprint cast by the country’s secret nuclear mining and fuel fabrication program. It is now the subject of a potentially powerful legal action, shining an unusual light on India’s nuclear ambitions and placing a cloud over its future reactor operations……..

On August 21, 2014, however, a justice in this state’s court ordered an official inquiry into allegations that the nuclear industry has exposed tens of thousands of workers and villagers to dangerous levels of radiation, heavy metals or other carcinogens, including arsenic, from polluted rivers and underground water supplies that have percolated through the foodchain — from fish swimming in the Subarnarekha River to vegetables washed in its tainted water.

Given the absolute secrecy that surrounds the nuclear sector in India, the case is a closed affair, and all evidence is officially presented to the judge. But the Center for Public Integrity has reviewed hundreds of pages of personal testimony and clinical reports in the case that present a disturbing scenario.

India’s nuclear chiefs have long maintained that ill health in the region is caused by endemic poverty and and the unsanitary conditions of its tribal people, known locally as Adivasi, or first people. But the testimony and reports document how nuclear installations, fabrication plants and mines have repeatedly breached international safety standards for the past 20 years. Official data now reveals hugh extent of Fukushima radiation to USA West Coast

When the plant first melted down, much of our population was justifiably alarmed. After all, many of us remembered the Chernobyl incident and how the radiation it produced spread all across Europe, and in smaller amounts, the world.

But the government assured us that everything would be fine, and at most we would see a negligible amount of radioactive particles in the United States. Everyone who said otherwise was and still is, called a quack or a conspiracy theorist.

However, official government data that was collected in 2011 has just seen the light of day, and it suggests that our initial concerns were probably correct. The information was collected by officials with Los Angeles County when concerns were raised by residents. After state and federal agencies failed to test the area for radiation in a timely manner, the county hired their own people to run the test. Natural News reported on the results.

Samples were taken between April 29 and May 2, 2011, approximately seven weeks after the radioactive releases from Fukushima. The county found that gross alpha radiation levels at a location in Los Angeles were 300 femtocuries per cubic meter (fCi/m3), and levels at a Hacienda Heights location were 200 fCi/m3.

For context, the Lawrence Livermore National Laboratory reports the average (annual median) level of gross alpha activity for the state of California as just 0.38 fCi/m3 – that is, 790 times lower.

The levels detected in Los Angeles County were a full 100 times higher than the level that requires an investigation at a U.S. nuclear laboratory, according to the Environmental Monitoring Plan at Brookhaven National Laboratory: “If the gross alpha activity in the [air] filters is greater than 3 fCi/m3, then collect more samples in the vicinity, and project manager will review all detections above the limits … All values greater than the above-stated gross alpha/beta concentration shall trigger an investigation.”

Finally, the Los Angeles County levels were almost 15 times higher than the federal regulatory limit for alpha radiation, which is 21 fCi/m3, according to a 2010 document from Idaho National Laboratory.

Moreover, the alpha radiation emitting particles that were deposited on the West Coast are incredibly dangerous for humans. While Gamma and Beta Radiation have far more power and penetration, Alpha rays produce a tremendous amount of damage in the human body when ingested. Because they don’t penetrate materials like Gamma rays do, all of their energy is deposited into the cells that reside near the particle.

More importantly, it doesn’t take very many of these particles to ruin your long-term health. For instance, if you were exposed to a temporary large dose of radiation, your body could probably recover from it, perhaps without even developing cancer. But when the particle itself is embedded in your tissue for weeks, months, and in some cases for years, as it destroys and mutates surrounding cells over and over again, you can expect a significantly shorter lifespan. Even if the amount radiation is small, it’s also continuous, and its source is difficult to remove

So while the government was telling us that everything was hunky dory in the weeks after the Fukushima meltdown, major West Coast cities like Los Angeles were being drenched in alarming levels of this radioactive waste.

Who knows how much of that fell onto the countless farms in the Central Valley, which feed much of the United States? And since they failed to inform us about the danger we were in then, who knows how much danger we are in now? Our government hates to admit when its wrong (or they won’t admit that they lied to us), so if we are still in danger, somehow I doubt they will have anything to say to us now.

14 DEC 2015 13:03 MATTHEW LE CORDEUR Cabinet has denied reports that it approved the start of the nuclear procurement programme just before Nhlanhla Nene was removed as finance minister. President Jacob Zuma’s Cabinet has denied claims that it secretly approved the start of the nuclear procurement programme during its meeting just before finance minister Nhlanhla Nene was fired last Wednesday.

Business Day journalist Carol Paton, who has a reputation for excellent sources, wrote on Monday that “the decision was made at the last Cabinet meeting of the year on Wednesday, after which Nhlanhla Nene was fired as finance minister. The approval was not announced by Minister in the Presidency Jeff Radebe in his Cabinet briefing on Friday.”

Acting Cabinet spokesperson Phumla Williams said in a brief response on Monday that she was not aware of this. “(I) saw it in Business Day.”

Nene stalled the 9 600 MW nuclear build programme, saying it was too expensive in the current economic climate. He had allocated R200-million in his mini budget for the departments of energy and finance to investigate the costing of the programme. There were no indications of this having produced any results.

Paton said “several independent studies have found that the cost of new nuclear energy will be greater than energy produced by other technologies”.

The nuclear process has been veiled in secrecy for over a year. As a result, non-governmental organisations (NGOs) Earthlife Africa Jhb and the Southern African Faith Communities Environment Institution approached courts to challenge government’s plans to procure nuclear reactors.

Nomura emerging market analyst Peter Attard Montalto told Fin24 on Monday that if Cabinet had approved the programme, it was very serious. “I believe this move is illegal under the Public Sector Finance Management Act. Major public procurement projects have to have National Treasury cost-benefit analysis and affordability sign off.”

Montalto believed Treasury provided initial evidence to Cabinet that the project was unaffordable, which was the “wrong” answer for Zuma. “Hence Nene was ousted,” he said.

Montalto said Finance Minister Pravin Gordhan had always objected to the nuclear deal due to the cost and the possibility of corruption.

“He was in the Cabinet meeting when it was approved (by a majority) and would not have been presented with funding/guaranteeing, as it was a done deal back at National Treasury. Maybe he even didn’t object to it given it wasn’t his area at cooperative governance?” – Fin24

India’s nuclear project is seen as the country’s most prestigious enterprise, a tangible expression of the nation’s resilience and resourcefulness. This idea was cemented when India tested nuclear devices in 1998, in twin blasts. Feeding the weapons program was UCIL’s duty, and protecting the mines became paramount.

As a result, the UCIL-funded health studies were not welcomed by the Bhabha Atomic Research Center, the country’s premier civil and military nuclear research facility, which has a Health Physics Laboratory in Jadugoda. It said in 1999, after a quick visual inspection of villagers living close to the mines, that its own experts “unanimously agreed that the disease pattern could not be ascribed to radiation exposure.” The complainers were “backwards people” who suffered from “alcoholism, malaria and malnutrition,” the company said. But it took no soil, water or air samples and launched no epidemiological study.

UCIL subsequently reversed its own position. “There is no radiation or any related health problems in Jadugoda and its surrounding areas,” J.L. Bhasin, the managing director of UCIL, concluded in 1999, in a press conference before local reporters in Jadugoda. A.N. Mullick, UCIL’s chief medical officer for 25 years, issued a press statement a few months later that “I have not come across any radiation-related ailments during my entire career.” Continue reading

Middleman for North Korea nuclear program found guilty

The case against Chinpo Shipping – which had transferred millions of dollars for North Korea – revealed a trove of information about how North Korea has been using intermediaries to send money through the international banking system without detection.

Why Japan’s government and media keep the silence on Fukushima radiation effects

[keeping quiet about radiation effects] In order to attempt to answer this question, let us break society into two groups: the government/nuclear power companies, and the ordinary Japanese people.

The level of intensity with which the former group have tried to diminish the seriousness of the incident and divert blame from themselves – by appealing to public well-being (avoiding panic), ‘radiophobia’, and the supposed harmlessness of radiation – leads to the obvious conclusion that they are acting to protect their own interests. Companies such as TEPCO (Tokyo Electric Power Company) wish to continue running so they can continue making money. It appears the government also wants to continue the use of nuclear power. This may be to do with nuclear power’s close relationship to war and military power, due to its association with nuclear weapons. It is no secret that the current government are in favour of restoring Japan’s military status, as evidenced by the recent changes to Article 9, which essentially render it meaningless.[24]

The down-playing of the catastrophe of Fukushima is crucial not only for economic reasons (the issue of the continuing operation of the remaining 54 nuclear power plants); it is also vital for the implementation of the state’s military plans for the future.[25]

In order to keep these plans, it is necessary to make everything feel normal, meaning there will be no questioning of nuclear power or of the government’s policies towards it. Information about radiation exposure would breed more empathy with the victims of Fukushima among the public, thus bringing the issue to a more personal level. This empathy could potentially cause a much larger number of people to become angry at the government and wish for the nuclear power companies to be held responsible. It is to avoid this situation that radiation exposure is intentionally not discussed in mainstream Japanese media……..

In order to break past the social stigmas and question the government and nuclear power companies’ actions, people need to start speaking out. But this is an extremely risky and frightening thing to do, especially in light of the treatment journalists may face if they discuss radiation exposure. At the end of the day, people need to make a living, put food on the table and protect their families. Thus, it is much easier to keep your head down and look the other way.

As we have seen, the social effects of the Fukushima nuclear incident are many, including displacement, poverty, depression, anxiety and social discrimination. These effects are all compounded by the media treatment of the incident: lack of information breeds fear and encourages discrimination, victims’ fears are dismissed as irrational, and the actions of the government and nuclear power companies are not questioned because it is made to appear as if everything is fine. The reason for such a reaction can be understood as the government and nuclear power companies protecting their own interests, both economically and militarily. Traditional conceptions of impurity combined with a general by-stander effect within Japanese society, also encourage discrimination and allow the status-quo to be maintained. Chris Hohn’s TCI hedge fund invested in J-Power, a Japanese utility company whose assets included nuclear power stations. In 2008, the Japanese government barred TCI from increasing its stake in J-Power and the hedge fund withdrew.

Vinod Khosla loves nuclear power and is on record blaming environmentalists rather than nuclear energy’s obviously disastrous economics, for its failure. “Most new power plants in this country are coal, because the environmentalists opposed nuclear”, Khosla said in a 2008 interview.

Chinese billionaire Jack Ma of Alibaba, was recently brought onto British Prime Minister David Cameron’s Business Advisory Group, probably not coincidentally one day before a state visit by the Chinese president to seal a deal involving China’s investment in the UK’s planned Hinkley-C nuclear power plant.

Did China dump nuclear trash in Northern Sudan?

The director of the governmental Dams Implementation Unit has strongly denied the “presence of containers with chemicals or harmful substances to Sudan from any other country”.

The former director of the Sudan Atomic Energy Commission in Sudan, Mohamed Siddig, said at a conference in Khartoum last Tuesday that 60 containers with nuclear waste were brought from China to Sudan during the construction of the Merowe Dam in the Northern State.

Siddig told the audience that 40 containers were buried in the desert not far from the Merowe Dam construction site. Another 20 containers were disposed of in the desert. He did not mention the date the waste was dumped, however China worked on the dam between 2004 and 2009. On Sunday, the spokesman for the caucus of the independent MPs, Mubarak El Nur, called for an immediate investigation into the alleged crime. The perpetrators should be brought to justice, he stressed.

The chairman of the Northern State’s parliamentary Services Committee, Ali Hassan Bateik, said that the northern MPs will also demand an investigation into the rapid rise of cancer and kidney failure in the region

Medics  The medical contingent of the Communist Party demanded that the government disclose the exact sites of the 60 Chinese containers.

In a statement on Sunday, the doctors emphasise the need for holding those involved in the operation accountable: “Charge them with murder, and sentence them to maximum penalties”.

The medics also blame the government for keeping silent on the growing number of people in the area who suffer from kidney failure or cancer.

Rumours The director of the governmental Dams Implementation Unit, Jaafar Mohamed Hammad, however, strongly denied the “presence of containers with chemicals or harmful substances to Sudan from any other country”.

He told the Sudan News Agency (Suna) in Khartoum last week that he will take legal action “against those who spread the rumours” about the dumping of Chinese nuclear waste in the Northern State.

In Japan, the “Nuclear Village” is in charge again

In Japan the propaganda warfare took a more sinister turn blaming the victims for their predicament. Japanese newspaper Asahi Shimbun that is closely connected to Japan’s ruling elite has run a series of articles on “radiophobia”, attributing health complaints of the affected to psychological and emotional stress.

The city’s website now is very optimistic in its proclamation of moving forward without nuclear power, despite the central government’s move to the contrary. The government in Tokyo has decided what is best for the citizens of Minamisoma and all of Japan.

Furthermore, nuclear power is back in charge as if it never left.  Nationalist Prime Minister Abe Shinzo’s administration is another one anointed by “kempatsu mura” – “the nuclear village”, power and money complex that has been a steady fixture in the history of modern Japan.  In 2012, Tokyo’s Waseda University researcher Tetsuo Arima disclosed declassified CIA documents dating to the 1950s. It was revealed that the long time kingmaker of Japanese politics, Matsutaro Shoriki and head of the country’s most powerful Yomiuri Shimbun media empire, worked hand in hand with the CIA to popularize nuclear energy as way for the future. Despite its peaceful angle and spin thrown onto the Japanese public that was still traumatized within a generation of the Hiroshima and Nagasaki bombings, Shoriki insisted the way to a successful future would have to include Japan’s nuclear armament………..

The long standing and corrupt practice of “amakudari” –“descent from heaven” which led to the capture of regulators by the regulated in form of career revolving doors has made any meaningful reform a pipe dream. This ultimately allowed the Tokyo Power Company (TEPCO), Japan’s largest utility, to defeat any efforts to improve plant safety as it would cost it too much money to comply with increased regulatory requirements. ………..

In Britain the government together with the industry decided on a strategy to spin the information released to the public as to avert a backlash against nuclear energy experienced in Germany as result of the disaster in Japan.

In Japan the propaganda warfare took a more sinister turn blaming the victims for their predicament. Japanese newspaper Asahi Shimbun that is closely connected to Japan’s ruling elite has run a series of articles on “radiophobia”, attributing health complaints of the affected to psychological and emotional stress. Ironically the same took place during a period of “radiophobia” scare doled out by medical professionals and nuclear experts in the Soviet Union after the Chernobyl disaster. Their fears and concerns were met with explanation that the victims were subjected and suffered from fear of radiation rather than the radiation itself. University of California anthropologist Adriana Petryna’s ethnographic study of the Chernobyl medical assessment and compensation system shown it was biased against the victims and politically manipulated. The same now applies to the case of Fukushima disaster victims as the more sophisticated forms of manipulation employing intrinsically Japanese traits of shame and group think are now used to shift the effects of the disaster onto victims’ own sense of responsibility. This allows the system to move on and not take responsibility for what transpired while using the cultural trait of the population’s acquiescence as a catalyst for its de facto forced amnesia.

Looking at the Japanese media and governmental space that work hand in hand to obfuscate its responsibility to inform, the truth of the matter is : the technology to decommission melted reactors doesn’t exist and the most optimistic scenario of final solution to the crisis is pure fiction.

As the country’s political establishment is readying itself to host the 2020 Olympics in Tokyo for which there is no public money or popular support whatsoever, the nuclear sword of Damocles will be hanging over it. The negligence and incompetence bordering on willful disregard for lives of its citizens makes the Japanese government a perfect candidate for prosecution under the crimes against humanity statues. Its handling of the Fukushima crisis puts into doubt Japanese credentials as a real democracy that is able and willing to address its citizens’ needs instead of using them as fodder for obscene corporate profits and foreign policy gamesmanship.

As a result Fukushima is worse than Chernobyl in many respects, making the difference between both political systems only a semantic one at best.

MAXIM MAN, November 12, 2015 By STEVE HUFF It’s the kind of scenario that fueled the novels of the late Tom Clancy: fuel that could form the core of a nuclear weapon on the black market, for sale to the highest bidder. Unfortunately, as a joint report from The Center for Public Integrity and Vice News has revealed, this fictional scenario is very real — and U.S. security officials have been in a constant state of concern about it for years.

The detailed report begins with an account of a failed attempt that occurred in Moldova in 2011 to pass off 22 pounds of highly enriched uranium for a few hundred thousand dollars. The transaction was actually a sting, and it ultimately led to the imprisonment of a Moldovan lawyer named Teodor Chetrus for attempting to smuggle the material. Chetrus’s arrest, however, did nothing to ease Western worries about a terrorist group or rogue nation acquiring the ability to make their own nuclear bomb:

Instead, it stoked them, because the resulting international probe into the case has sparked fresh, and previously unreported worries, that thieves inside of Russia somehow made off years ago with a full bomb’s worth of highly enriched uranium. Western spies fear the thieves have been doggedly looking for a buyer for the past sixteen years, by repeatedly dangling in front of them identical, genuine samples of that highly valuable material.

Five current or former U.S. officials who have tracked nuclear smuggling, and who declined to be named because this assessment is classified, said it is now a consensus view within the intelligence community.

But wait, it gets worse! According to this report, Western intelligence has no idea “exactly who has this nuclear explosive material, and where they may be.”

Journalists Douglas Birch and R. Jeffrey Smith write that the anxieties regarding nuclear materials in the wild go back some 16 years. Since 1999, there have been at least three incidents in which “identically packaged containers of highly-enriched uranium have been seized by authorities outside of Russia.”

All those packages have been forensically traced to the early 1990s and one source: the Mayak Production Association, a giant nuclear facility in the Ural Mountains.

One quote from the report ratchets up the pucker factor considerably while emphasizing exactly why this is the stuff of military suspense fiction:

While seven of those involved in the smuggling have so far been prosecuted in Bulgaria, France and Moldova, officials say they are just low-level members of a shadowy international ring with Moldovan and Russian connections, all working for a person or persons whose identity remains cloaked.

So far, efforts at stopping the spread of these materials has only taken small-time go-betweens out of commission. The masterminds are still out there.

Reading the report in full is worth the time, if you don’t want to sleep well for a while. It will make you wish James Bond was real.

Families who sent their kids to the camp, as well as former camp staff and board members, say top leadership, including a famous TV personality, covered up evidence of the risk and continue to hide important information.

“It’s criminal not to disclose this,” said Erwin Sokol, a counselor at the camp in the 1950s, who later sent his own kids there, and whose wife Caren served on the board of directors. “There are people’s lives at risk.”

Sokol is referring to the Brandeis-Bardin Institute next to Simi Valley, a world famous center for Jewish learning, which runs Camp Alonim for kids and teens and hosts retreats for college students and adults. Purchased in 1947, the 2,800-acre camp is believed to be the largest piece of Jewish-owned land outside of Israel. It sits just over the hill from the Santa Susana Field Lab.

Former Santa Susana Field Lab workers told NBC4 during our LA’s Nuclear Secret investigation that for years, barrels of radioactive waste were burned in a pit right above the Brandeis property, and the radioactive smoke often blew toward the camp.

Workers also told the I-Team how they were ordered to secretly release radioactive gases into the air from crippled nuclear reactors, often when the wind was blowing the gases toward Brandeis and Simi Valley. John Pace, who worked the controls of one of the reactors, told NBC4, “The truth needs to be told” about the secret releases of radiation.

Families Ask I-Team to Investigate Over a dozen former Brandeis senior staff, camp families and board members told the I-Team they tried for years to find out the truth about potential contamination at Brandeis, but were stonewalled by the Institute’s top leaders.

“This is about protecting the health of children,” said Erwin Sokol.

The I-Team found reports, studies and tests that show campers and staff could have been exposed to radioactive materials and toxic chemicals from the Santa Susana lab that migrated onto the Brandeis property through groundwater, surface water and wind.

Buried away at a National Archives warehouse in Riverside County, the I-Team found a 1997 report done by a scientist, Joel Cehn, who has worked for by Brandeis for years to monitor contamination on its land.

In the report, Cehn writes that after reviewing studies of Brandeis, in his opinion, “Brandeis property is contaminated… with radiological and chemical contaminants. Contaminated groundwater is moving toward the center of the Brandeis property (from south to north).”

Cehn also says, “Surface water, when present, also moves toward the center of Brandeis… some of this water is contaminated with tritium, strontium-90 and dioxins. Soil on the Brandeis property is contaminated… During rainwater runoff events, this soil is carried… to central and northern areas of the Brandeis property. Vegetation on the Brandeis property is contaminated.”

A Cover-Up

“If I had seen this document, I would not have taken the job,” said Rabbi Lee Bycel, who became president of the Brandeis-Bardin Institute in 2000 and served until 2003………

With some 18,000 subscribers Dana has been touted as a “leader” of the anti nuclear movement but as Fukushima 311 Watchdogs on Facebook gets some 11,000 subscribers, the Campaign for Nuclear Disarmament in the UK has some 30,000 members and this does not include a recent surge in membership from Scotland, Wales and England due to the promotion of no nuclear by The extremely popular Jeremy Corbin. I also do not include the tens of thousands Taiwanese activists, Indian activists, Japanese activists etc etc who visit many of the more moderate anti nuclear web pages and social media formats.

Dana remembered

Dana Durnsford occupies a small part of the nuclear debate. When his You Tube channel began streaming his show and saying that the west coast of Canada was a dead zone, to say the least I was a bit concerned! I was on the Rainbow Warriors on Facebook and we crowd sourced an investigation with some Canadian colleagues (including First Nations) to find out what the situation was. We quickly discovered over a couple of days that the coast was still the same as it was in previous years. This was testimony from witnesses that I have grown to trust so I was distrustful as to Danas Claims but decided to see what evidence he could supply.

Over the coming months he sought Funding for a boat and camera equipment but no radiation detectors of any sort. Further videos of people showing a thriving environment  on You Tube made me doubt further the veracity of his claims. Also, his aggressive stance and lack of multiple sources for news weakened my interest and I quickly moved on.

A right to speak

My general attitude to Dana was that he was providing a service to those that thought that the effects from Fukushima were dire. Of course there are many viewpoints to the ultimate effects from the Fukushima Daichi nuclear disaster in march 2011.

My view was that there is room for debate on this issue. I also thought that the debatably entertaining way that Dana discusses nuclear matters might encourage people to learn more on the nuclear issue so the show had a more serious educational aspect to it (even though some of the science and posits might be questioned).

Sentenced to what?

So, to the issue of what might happen to Dana? The use of harassment is a thorny issue on social media. In the UK Chris Spivey was recently charged for a similar style of blogging. Leaving aside the issues on free speech for the moment I will quickly describe his present situation. chris-spivey

Chris has a short suspended prison sentence hanging over him and is under instruction to not have on his website any information related to the court case (Lee Rigby) nor can he discuss this news publicly. Chris has continued his blogging as normal, still using an aggressive style but with some sensible caution. So Dana should take heart. My co host Jimmy Hagan contacted Chris Spivey for a statement and he said that if it is a first offence a prison sentence is unlikely and a suspended sentence with blogging restrictions would apply.

Of course the Pro nuclear media is trying to milk this for everything it is worth but we need to bear in mind that Dana`s views only represent a small fraction of the worlds anti nuclear campaigners. In the diverse world-wide web there is room for many opinions and views.

What learning can we all take from this?

There is an important point to be had here for bloggers more generally and that is the need for caution considering that harassment cases are an effective tool for corporate and government interests and we as bloggers should be mindful to avoid such pitfalls. We should be prepared to adapt to this sort of pressure on our freedom of speech. The main points we have to raise do not include personal attacks but science based evidence and personal testimonials and independent science research where science research is being suppressed.
