It was a precaution against tracking hazardous, radioactive materials into the family’s home in rural Barnwell County, says his widow, recalling how she would gingerly place the contaminated garment into the washing machine.

But while the effort protected the couple’s three kids, Jerry Bolen suffered. The long days he spent working at the Savannah River Site, exposed to chemicals and radiation, eventually killed him, his widow says.

Now, an exasperated Carolyn Bolen has sued the U.S. Department of Labor following a 13-year battle with the government over whether the family should receive compensation for the cancer that took Jerry Bolen’s life in 2006.

Her story is a familiar one. Many people who worked at SRS have complained for years that a federal compensation program for sick workers and their families is a bureaucratic morass that takes too long to maneuver and often doesn’t provide the benefits they were promised.

In Carolyn Bolen’s case, however, she was turned down so many times for benefits through the federal program that she exhausted all her appeals, prompting the federal lawsuit, she and her lawyers say.

The Nov. 20 suit against the labor department is among a handful of cases in South Carolina by ex-SRS workers and their families who were denied benefits in recent years through the federal compensation program, said Bolen’s lawyers, who specialize in helping sick workers.

Bolen’s attorneys said the labor department ignored overwhelming evidence that her husband became sick from working at SRS. They are seeking $275,000, the maximum she can get under the program. Other suits are expected as more workers or their loved ones are turned down by the government, said attorneys Warren Johnson and Josh Fester.

The federal government launched the compensation program two decades ago after conceding that employment at nuclear weapons sites likely made some of the workers ill. It was designed to help former employees who got sick working in U.S. nuclear sites during the Cold War.

To receive compensation, workers or their families must show that radiation on the site was as likely as not to have caused cancer or a handful of other ailments. Or, in some cases, they must show that people worked on the site during times when records of exposure are difficult to find.

The nuclear compensation program provides benefits to sick workers, but in some cases, covers their families after the person has passed away, such as with Bolen.

Unfortunately, the system has become hard to navigate, with the government often fighting tooth-and-nail against the workers they were supposed to help, Johnson said. Taking legal action to force federal compensation shouldn’t be necessary, said Johnson and Fester, whose law practice has represented sick SRS workers for years.

“This was supposed to be a way to make up for, or show our gratitude to these patriotic workers,’’ Johnson said of the compensation program. “They gave their health for our sake for the Cold War. We can at least offset the burden, by giving financial security, knowing they aren’t leaving a burden on their wives and children.’’………..

In 2015, the labor department told The State and the McClatchy Co. the program had approved more than 40 percent of the claims made by nuclear workers and their families, far more than the 25 percent the government anticipated when the program launched in 2001. The labor department said Friday the approval rate nationally is now more than 50 percent.

Even so, many claims don’t get approved and the wait for answers can be time-consuming. More than 2,200 workers had spent five years or more going through the exhaustive claims process, according to McClatchy’s 2015 “Irradiated’’ series. Some workers who filed for benefits died while awaiting decisions from the government, McClatchy found.

Earlier this month, a federal panel considered a proposal, advocated by Johnson, that could make it easier for thousands of workers and their families to receive benefits. But the board put off a decision until next year…………

he never complained about the long hours or said much about hazardous conditions at the site. That was important to the federal government because, during the Cold War, much of the work on the Savannah River Site needed to be kept confidential, family members say.

Tim Bolen, his son, said he never knew his father worked at SRS until just a few weeks before his death. But Carolyn Bolen did.

She remembers the days her husband came home with his coveralls coated in “white stuff’’ that she says came from the Savannah River Site. Bolen never knew what the material was, but she was always wary of the potential danger. And her husband occasionally offered clues that the white material came from SRS, she said……….

The site, a 310-square-mile complex, contains an array of nuclear production areas with some of the most toxic substances in the world.

Among them is a tank farm, which houses nuclear waste deadly enough to rapidly kill a person directly exposed to it. Carolyn Bolen’s lawsuit says her husband worked for a while in the tank farm area and another section where radioactive material is used.

The Savannah River Site, located near the Georgia border outside Aiken, was part of the national effort to produce atomic weapons between World War II and the early 1990s. Nationally, the effort employed some 600,000 people, according to the U.S. Government Accountability Office……

After working periodically at SRS through the years, Jerry Bolen began to feel an uncomfortable sensation in the late 1990s that he couldn’t shake.

Something was wrong with his bladder. During trips to the bathroom, bloody urine flowed into the toilet and a sharp sting caused him to gasp. The pain was so bad, at times, that Carolyn Bolen could hear her husband’s cries throughout the house.

“He just screamed for mercy,’’ she said.

The discomfort sent him to a doctor, where the family learned the man who had faithfully kept a roof over their heads and food on the table was gravely ill. He had bladder and prostate cancer…….

In August 2006, Jerry “Little Mac’’ Bolen died at the age of 60, leaving his wife and family wondering how the once robust man could slip from their world. It didn’t seem right that a man so young and energetic had become so sick, family members say. …….

MISSING RECORDS

Jerry Bolen’s time at SRS, and his devotion to his family, haven’t impressed federal officials who have considered whether his family is eligible for benefits through the labor department’s sick worker compensation program. They’re skeptical an award to his widow is warranted, saying they need more evidence.

An obstacle some workers face is gaining access to records that could show there is at least a 50 percent chance radiation caused cancer they developed after working at the Savannah River Site, a complex developed in the early 1950s.

Many records either can’t be located, are inaccurate or don’t exist, meaning workers can’t prove how many days they worked on site, or the amount of radioactive material they might have been exposed to.

That’s a particular concern for subcontractors like Bolen, who did not work directly for the government or for the major contractors hired by the U.S. Department of Energy to run the site. Subcontractors often were local construction companies brought in to do specific jobs.

Johnson and Fester said records of subcontractors often are harder to find than those for energy department workers.

In Bolen’s case, the labor department turned down the family’s claim for benefits because “the submitted documentation does not establish covered SRS employment for the employee,’’ according to the federal lawsuit Carolyn Bolen filed. In declining comment on the Bolen case, a Department of Labor spokeswoman said Friday that claims can be turned down for a variety of reasons…..

Bolen’s lawsuit, however, said the labor department simply dismissed credible evidence that would prove the case. Jerry Bolen, for instance, worked with acquaintances or for his brothers’ construction businesses in the late 1960s, 1970s and 1980s, according to five affidavits filed in Carolyn Bolen’s federal lawsuit last month.

Those affidavits, provided by family and friends who worked with Jerry Bolen, were combined with SRS identification badges issued in his name, and records of radiation doses the family ran across in his belongings. Some material was unearthed and provided to the government after the labor department had initially denied requests for compensation.

Despite the evidence, the Department of Labor ruled against the Bolen family’s request for reconsideration this past summer. Her case had been turned down at least three times before 2020.

“The department simply ignored additional evidence that Mr. Bolen was present at the site before 1968 and after Jan. 24, 1969,’’ the lawsuit said. “Mrs. Bolen’s request for reconsideration further asserts the department misapplied the law in determining covered employment by holding Mrs. Bolen to an impossible burden of proof.’’

While the Bolens have been turned down repeatedly in seeking compensation, Johnson and Fester are hoping the lawsuit will succeed. Fester said one of the five other cases the firm has filed resulted in a verdict that would have required payment to a sick worker. But the worker died before benefits were dispersed.

In the meantime, Fester and Johnson are pushing the federal government to approve a proposal that could open up benefits to thousands of people who worked at the Savannah River Site.

Under federal law, the government can acknowledge that it is too difficult to find records during certain years that would prove a person’s case for compensation for radiation-related cancer. As a result, the government can declare periods of years free of the need to provide records showing that a person likely got cancer from working at SRS.

The government already has done that for the time from 1953 to fall 1972. Some ex-workers at SRS, who were employed there for at least 250 days between these times, are eligible for benefits without producing extensive documentation about exposure to radioactive materials.

Now, a federal advisory board is considering whether to extend that to cover up to 1990 for some types of workers at SRS. It’s clear that Jerry Bolen worked well above 250 days between 1972 and 1990 at the site, so it’s possible his family could gain compensation if the time period is expanded to 1990, Johnson and Fester said.

A decision, under consideration for years, could be rendered as early as February if the federal advisory board recommends expanding the period. Such a decision ultimately would be made by the U.S. Department of Health and Human Services, the labor department said Friday.

Carolyn Bolen said a favorable decision — and her lawsuit — would mean a lot to many people who need help after they or their loved ones got sick at SRS.

“There are a lot of poor people in this world, and they don’t have the money like the president or the people in the White House,’’ she said. “I ain’t just talking about myself. There are people with needs.’’

In a massive cyber-attack, U.S. nuclear agency has been hacked

The U.S. nuclear weapons agency and at least three states were hacked as part of a suspected Russian cyber-attack that struck a number of federal government agencies, according to people with knowledge of the matter, indicating widening reach of one of the biggest cybersecurity breaches in recent memory.

Microsoft said that its systems were also exposed as part of the attack.

Hackers with ties to the Russian government are suspected to be behind a well coordinated attack that took advantage of weaknesses in the U.S. supply chain to penetrate several federal agencies, including departments of Homeland Security, Treasury, Commerce and State. While many details are still unclear, the hackers are believed to have gained access to networks by installing malicious code in a widely used software program from SolarWinds Corp., whose customers include government agencies and Fortune 500 companies, according to the company and cybersecurity experts.

“This is a patient, well-resourced, and focused adversary that has sustained long duration activity on victim networks,” the U.S. Cybersecurity and Infrastructure Security Agency said in a bulletin that signaled widening alarm over the the breach. The hackers posed a “grave risk” to federal, state and local governments, as well as critical infrastructure and the private sector, the bulletin said. The agency said the attackers demonstrated “sophistication and complex tradecraft.”

The Energy Department and its National Nuclear Security Administration, which maintains America’s nuclear stockpile, were targeted as part of the larger attack, according to a person familiar with the matter. An ongoing investigation has found the hack didn’t affect “mission-essential national security functions,” Shaylyn Hynes, a Department of Energy spokeswoman, said in a statement.

“At this point, the investigation has found that the malware has been isolated to business networks only,” Hynes said. The hack of the nuclear agency was reported earlier by Politico.

Microsoft spokesman Frank Shaw said the company had found malicious code “in our environment, which we isolated and removed.”……..

Biden’s Pledge

While President Donald Trump has yet to publicly address the hack, President-elect Joe Biden issued a statement Thursday on “what appears to be a massive cybersecurity breach affecting potentially thousands of victims, including U.S. companies and federal government entities.”

“I want to be clear: My administration will make cybersecurity a top priority at every level of government — and we will make dealing with this breach a top priority from the moment we take office,” Biden said, pledging to impose “substantial costs on those responsible for such malicious attacks.”

An important yet discreet part of the inauguration of a new president is the transfer of command and control authority over the US nuclear arsenal, but there is the possibility President Donald Trump will not attend President-elect Joe Biden’s inauguration, which could complicate matters.

Trump has refused to say whether he will attend Biden’s inauguration, but multiple reports have suggested that the president will skip the swearing-in ceremony of his successor and hold a political rally elsewhere instead.

So what happens to the “nuclear football” that accompanies the president if Trump doesn’t show? How does it get to Biden?

“That’s a good question,” Hans Kristensen, a nuclear weapons expert at the Federation of American Scientists, told Insider. “It is an unprecedented situation.”

The president has the sole authority to conduct a nuclear strike, and wherever he goes, he is accompanied by a military aide carrying a briefcase called the “president’s emergency satchel,” more commonly known as the nuclear football.

Every president since John F. Kennedy has been accompanied by the aide carrying the hefty briefcase, which gives the commander in chief the ability to command US nuclear forces while away from physical command and control centres.

The briefcase does not contain a button that can instantly unleash hundreds of nuclear warheads deployed on intercontinental ballistic missiles, submarine-launched ballistic missiles, and strategic bombers. Instead, the briefcase contains communication tools, codes, and options for nuclear war.

Separate from the football, presidents carry a card, sometimes called the “biscuit,” on their person containing authentication codes. In a nuclear conflict, the president would use the codes in coordination with the tools in the briefcase to identify himself to the military and order a nuclear strike.

Incoming presidents are typically briefed on their nuclear responsibilities before taking the oath of office. Then, during the inauguration, the codes they received that morning or the day before become active, and control of the football is quietly and seamlessly passed to the new president.

Trump described that moment as “sobering” and “very scary,”telling ABC News in 2017 that “when they explain what it represents and the kind of destruction that you’re talking about, it is a very sobering moment.”

The transfer of the nuclear football is supposed to occur at noon as the new president is sworn in. The military aide who has been carrying the briefcase hands it off to the newly designated military aide, former Vice President Dick Cheney said in a past Discovery documentary. This traditionally happens off to the side and is not a part of the show.

If Trump is not at the inauguration, then the transfer process will be different. Still, the transfer will need to be instantaneous, said retired Air Force Lt. Col. Buzz Patterson, who carried the football for former President Bill Clinton.

“That’s the way it has to be,” he told Insider. “For the process to work, you have to have this clear handing off of responsibilities.” He said that how that happens would be up to the Pentagon, which serves the office of the commander in chief, not the man.

A Pentagon spokesperson told Insider the Department of Defence had a plan for the transfer on Inauguration Day but declined to provide any further details.

“We war game this stuff, and we practice it ad nauseam for years and years,” Patterson said. “There are systems in place to make sure that happens instantaneously. There won’t be any kind of question about who has it, who is in charge at that point in time.”

“We don’t take this stuff lightly,” he added. “There won’t be any kind of hiccup. It will just go down without anybody even noticing, which is what is supposed to happen.”

Kristensen, the nuclear weapons expert at FAS, speculated that the plan could resemble plans in place for situations in which a president is suddenly killed or incapacitated, situations in which nuclear command and control authority and all accompanying equipment have to be immediately transferred to the vice president or another designated survivor.

Stephen Schwartz, a nonresident senior fellow with the Bulletin of the Atomic Scientists, recently discussed with the Centre for Arms Control and Non-Proliferation what would happen to the nuclear football if Trump did not attend the inauguration.

Schwartz, known for his research on the nuclear football, said there was more than one football. In fact, he explained, there are at least three of them — for the president, vice president, and a designated survivor.

He said that if another nuclear football had not already been prepared, one likely would be before the inauguration. There would be a military aide ready then to begin following Biden as soon as he is sworn in. And, at that time, Trump’s nuclear command and control authority would presumably expire.

“Hopefully President Trump will be there and it will be just a handoff, which is what it’s been for decades,” Patterson said, adding that if he didn’t, “it’s not that big of a deal” because the military will make sure that the transfer occurs as needed.

Russian hackers evaded layers of U.S. security to attack America’s military and intelligence agencies

New York Times 14th Dec 2020, The scope of a hack engineered by one of Russia’s premier intelligence agencies became clearer on Monday, when some Trump administration officials acknowledged that other federal agencies — the State Department, the Department of Homeland Security and parts of the Pentagon — had been compromised. Investigators were struggling to determine the extent to which the military, intelligence community and nuclear laboratories were affected by the highly sophisticated attack.
United States officials did not detect the attack until recent weeks, and then only when a private cybersecurity firm, FireEye, alerted American intelligence that the hackers had evaded layers of defenses.

Representative Adam Smith Asserts that Failed Plutonium Fuel (MOX) Project at SRS is “Pretty Close to White Collar Crime”.   The powerful chairman of the House Armed Services Committee, Representation Adam Smith, has raised great doubt about the U.S. Department of Energy’s ability to pull off the project at the Savannah River Site (SRS) in South Carolina to produce plutonium “pits,” or cores, for nuclear warheads.

In an on-line presentation on December 11 with the Center for Strategic and International Studies, Rep. Smith (D-WA) expressed deep concern in the ability of the DOE’s National Nuclear Security Administration (NNSA) to pull off the project to convert the partially finished plutonium fuel (MOX) plant, halted in 2017, into the proposed Plutonium Bomb Plant (PBP) at SRS. The event featured Rep. Smith talking about nuclear weapons matters coming before Congress in 2021. The transcript of the event was released late in the afternoon of December 11.

The skepticism of Rep. Smith about pit production at SRS was based in part on his continued concern about NNSA’s role in the failed MOX project at SRS: “Because the thing that really sticks in my craw on this basic competency issue is the Savannah River Site and the MOX facility. OK, that is pretty close to white collar crime, all right?” The public interest group Savannah River Site Watch believes Congress should follow through and conduct investigations into the MOX debacle.

Smith’s comments on pit production at SRS were harsh and, noting the mismanaged construction of the MOX building, said “So I am highly skeptical that they’re going to be able to turn that building into an effective pit production facility – highly skeptical.” He reiterated skepticism in NNSA’s ability and said “I am highly skeptical of the level of competence within the NNSA.”

Concerning the potential monetary waste on the pit project at SRS, Rep. Smith recognized parochial financial interests near SRS pushing for the pit project at the site and said “But if they’re going to have that say, they’d better not use that say to take $6 billion and dump it down a rat hole in South Carolina. The US detonated its largest nuclear bombs around the Marshall Islands in the 1940s and 50s – but the Marshallese are still campaigning for adequate compensation.

The Marshall Islands are two chains of 29 coral atolls in the middle of the Pacific Ocean between Papua New Guinea and Hawaii.

Following the tests, whole islands ceased to exist, hundreds of native Marshallese had to be relocated off their home islands and many were affected by fallout from the testing.

In 1977, US authorities put the most contaminated debris and soil into a huge concrete dome called the Runit Dome, which sits on Enewetak Atoll and houses 88,000 square metres of contaminated soil and debris.It has recently received media attention as it appears to be leaking, due to cracking and the threat from rising sea levels, while some Marshallese have fears it may eventually collapse.

However, American officials have said it’s not their problem and responsbility falls on the Marshallese, as it is their land.

The US has cited a 1986 compact of free association, which released the US goverment from further liability, which will go up for renegotiation in 2023.

Meanwhile, the Marshallese continue to campaign for adequate compensation from the US.

Giff Johnson, editor of the country’s only newspaper the Marshall Islands Journal and RNZ correspondent, has experienced the unfolding legacy of US nuclear testing first hand. His wife Darlene Keju, an outspoken advocate for test victims and nuclear survivors, herself died of cancer in 1996.

While he said that suggestions that the Rumit Dome – nicknamed “The Tomb” by locals – was about to collapse were alarmist, there were still major concerns surrouding it.

“I wouldn’t say the dome is on the verge of collapse, there’s concern about its leaking, about cracks, and also about the overall contamination of that atoll,” he said.

“The issue is it’s got plutonium, which has a half-life of 24,000 years, and how long does concrete last?”

Describing the structure as a “symbol of the nuclear legacy here”, Johnson said that US government scientists had reported there was already so much contamination in the area that it would be difficult to find what leakage from the dome had added.

The United States has continued to refuse to accept responsibility for the Runit Dome’s condition, despite its history of nuclear testing in the country.

In 1954, the US carried out their first nuclear weapon test, Castle Bravo, at Bikini Atoll in 1954 – which resulted in the contamination of 15 islands and atolls. Only three years later, residents on the affected atolls of Rongelap and Utirik were encouraged to return to their homes, so researchers could study the effects of radiation.

“The nuclear weapons test legacy is the overriding issue in the Marshall Islands with the United States and it remains a festering problem, because US compensation and medical care and so forth was only partial for what was needed,” Johnson said.

The first compact to free association between the Marshall Islands and the US contained a compensation agreement, including the establishment of a nuclear claims tribunal to adjudicate all claims. While it determined there was a large amount of compensation due to Marshallese on various atolls, this has never been paid out, apart from funding of $150 million in 1986.

Since then, the US has accepted no more liability on nuclear compensation, as the compact resulted in the Marshall Islands being an independent country, able to join the United Nations.

However, Johnson said the United States Congress had taken a different position on this.

“For example, while the US executive branch would say, well the Marshall Islands is in charge of all the former nuclear test sites, the US Congress a few years back passed legislation requiring the US Department of Energy to monitor the Runit Dome, where so much radioactive waste is stored.”

There have also been big differences in the treatment of Marshallese nuclear victims and those in the United States

“The US used Bikini and Enewetak to test its biggest hydrogen bombs,” Johnson said. “While it maintained a nuclear test site in Nevada, it only tested relatively small nuclear devices there, because it simply could not test hydrogen bombs in the continental United States – Americans wouldn’t have stood for it.”

Not long after the 1986 free association compact ended American responsibility for nuclear compensation in the Marshall Islands, the US Congress enacted a radiation compensation act for Americans – which Johnson said really emphasised the unfairness of the situation.

“Long story short, they appropriated $100 million and then they ran out, the US congress appropriated more, again ran out, appropriated more and fast-forward to 2020 and they’re over $2 billion in compensation awarded to American nuclear victims.

“Then the question comes, that if they’re willing to just keep recapitalising the compensation fund for American nuclear victims, why aren’t they able to reinstitute the compensation fund for Marshallese, who were exposed to far more nuclear fallout than the downwinders in Utah and Nevada?”

Johnson also had concerns about the lack of a baseline epidemiological study by the US, following the tests. Studies on the affects of radiation centred around thyroid issues, but many islanders have reported cancer, miscarriages and stillbirths in the years following.

His wife Darlene Keju died of breast cancer, which also affected her mother and father – she grew up on one of the islands in the downwind zone of the tests.

The US had never looked at rates of cancer, or studied the differences between low fallout and high fallout areas, he said.

Johnson hoped the nuclear legacy between the countries could be worked out amicably, but he wasn’t too optimistic.

“The original compensation agreement was negotiated in a period of the Cold War and the US did it in an adversarial way with the Marshall Islands, which had no standing because it wasn’t a country at the time, information was withheld, they didn’t know what they know today, and it needs to be worked out, a suitable decent fair agreement needs to be sorted out.”

Despite this tension, Johnson said the Marshallese did not harbour anti-American sentiment and the compensation issues were a “black mark on an otherwise good relationship” between the two countries.

He said around 30 to 40 percent of all Marshallese were living in the US.

“The Marshall Islands, since WWII, has a very long standing high regard and strong relationship with the US that came out of the end of the Japanese period of militarism and the execution of many islanders and privation, into a period where the US fostered democratic institutions, created opportunities for education, providing scholarships, opening the door to people going to the US and the unpacked treaty really put this together, in terms of the relationship that’s of benefit to both sides.”

However, ongoing tensions between the US and China may help the Marshall Islands in their push for further compensation.

“In the current situation where we have the US continuing to be in an uproar over China … that has elevated the strategic importance of the Marshall Islands, the Federated States of Micronesia, Palau – the three north Pacific countries that are all in free association with the US. It does give the Marshall Islands a bit more leverage in negotiating and talking with Washington.

“Possibly the changing geopolitical situation out here might offer an opening to get some interest to try to amicably do something to resolve the whole thing,” Johnson said.

But the nuclear legacy is not the only issue affecting the island – climate change is looming large and reports by US scientists have said that the Marshall Islands could be uninhabitable by the 2030s, due to rising sea levels.

“Because the Marshall Islands has such little land, these are really small islands, it magnifies the importance of land to Marshallese people,” Johnson said. “I think people care about their islands and want to find a way to make them liveable for the long term, but that may depend on the world community to a great extent now.”

Indigenous opposition to uranium milling and the import of radioactive material

When locations were chosen more than half a century ago for the dozens of uranium mills that dot the Four Corners landscape, one common factor was almost always considered: proximity to productive uranium mines.

The region’s best uranium deposits typically only contain a small percentage of the valuable radioactive mineral, and being able to process the material at a nearby mill was critical to saving on transportation costs.

For the last conventional uranium mill still operating in the United States, however, the business model has changed. San Juan County’s White Mesa Mill, which is owned by the Denver-based company Energy Fuels Resources, hasn’t processed ore from local mines in recent years. Instead, it has survived primarily by accepting uranium-bearing material from around the country and, more recently, as far away as Japan. State regulators are also considering an application from the company to import material from Estonia.

Members of the Ute Mountain Ute community of White Mesa, which is located three miles from the mill site, spoke out against the mill’s continued operation on Tuesday at an annual town hall event that was held virtually this year due to the coronavirus pandemic.

The event, which was sponsored by a coalition of 12 grassroots community groups and environmental organizations, featured presenters from across Indian Country who spoke about the legacy of uranium production and nuclear waste storage on Native Americans as well as the White Mesa Mill.

“The White Mesa Mill was originally designed to run for 15 years before being closed and cleaned up, but the mill is still in operation 40 years later,” said Talia Boyd, cultural landscapes program manager for the Grand Canyon Trust and a member of the Navajo Nation, who noted uranium production has had a disproportionate impact on Indigenous peoples. “Community members are concerned about public health impacts and contamination of land, air and water as well as the mill’s ongoing desecration of cultural and sacred sites.”

The mill has accepted radioactive material from the Cherokee Nation in Oklahoma, and Energy Fuels has expressed interest in processing tailings from the more than 500 abandoned uranium mines that have yet to be cleaned up on the Navajo Nation.

Scott Clow, environmental programs director for the Ute Mountain Ute Tribe, said that such proposals address a real need to remediate contaminated sites on tribal lands, but that they also “pit tribes against tribes.”

“We all want those places to be cleaned up, but we don’t want it to go to White Mesa,” Clow said.

Thelma Whiskers and Michael Badback of the White Mesa Concerned Community group said emissions from the mill can be smelled in White Mesa on a regular basis, adding they believe the facility has had negative health impacts on local residents.

“Let’s just keep … fighting to not have [the mill] close to the reservation,” Whiskers said. “I care for the community members and the children and the grandchildren.”

Energy Fuels has repeatedly told The Salt Lake Tribune the mill is in compliance with all environmental regulations and both air and water quality are actively monitored, but Clow expressed concerns about the state’s repeated decision to relax compliance limits for certain contaminants present in the groundwater directly beneath the mill. The company has argued the contaminants, including chloroform and nitrate/chloride, are nonradioactive and originated with previous industrial activity on the site or are naturally occurring.

In an effort to better understand both the potential environmental and health impacts of the mill, Clow said the tribe has projects underway with both the Centers for Disease Control (CDC) and the Environmental Protection Agency (EPA).

Two new monitoring wells were drilled this fall between the mill and the community with EPA funding in order to better track potential water quality changes, Clow said, and a branch of the CDC is helping the tribe plan epidemiological work in the White Mesa community that could provide more information about health concerns among residents.

Other speakers at the event addressed the legacy of uranium production elsewhere in Indian Country.

Taracita Keyanna of the Red Water Pond Road Community Association spoke about the 1979 Church Rock Spill on the Navajo Nation in New Mexico, which remains the second-largest radioactive disaster in world history after the Chernobyl meltdown in the former Soviet Union.

“A lot of the land in our community has been disrupted and we can no longer use it [for livestock],” she said. “We can’t grow crops because the EPA has stated that if we grow crops we’ll be further exposed to uranium contamination. We can’t drink the water.”

Keyanna added the uranium contamination has had not only physical health consequences but has caused spiritual and mental health impacts as well, all of which have been exacerbated by the pandemic.

“It feels like a prison,” Keyanna said. “We’re not only prisoners during this pandemic, but we’ve kind of always been prisoners [since] this uranium industry started in our community.”

Leona Morgan, co-founder of the Indigenous-led group Haul No!, which opposes Energy Fuels’ plans to mine for uranium near Grand Canyon National Park and haul ore across the Navajo Nation, encouraged meeting participants to oppose a separate proposal currently being considered by the Nuclear Regulatory Commission that could result in radioactive material being hauled from the Church Rock area to the White Mesa Mill for processing.

Tom Goldtooth, executive director of the Indigenous Environmental Network, called the mill’s activities near the Ute Mountain Ute land, like the mining and milling that took place on the Navajo Nation decades ago, an example of “environmental racism and environmental injustice.”

“It’s not just an individual human rights issue,” he said, addressing the residents of White Mesa. “It’s a collective rights issue for your people to live in a safe and healthy environment: your homeland.”

December 11, 2020  The House Armed Service Committee chairman’s advice to the incoming Biden administration is to put together a National Defense Strategy in its first six to nine months in office that will provide direction for further review of nuclear policy and budget-building.

As part of that strategy, “I think we should have a no-first-use policy” because “nuclear weapons are a special case. They are “weapons that could destroy the planet.” Rep. Adam Smith, (D-Wash.) said while speaking at a Center for Strategic and International Studies online forum Friday said he also wants the United States to maintain “robust deterrence” but delivered with “a more cost-effective approach.”

Left-leaning Democrats see these efforts “as pivoting to a new Cold War” that will “come into conflict with Russia and China.”
