U.S. Supreme Court rejects challenge to nuclear subsidy

Supreme court denies challenge to NY nuclear subsidy, Houston Chronicle, James Osborne April 15, 2019 WASHINGTON – The U.S. Supreme Court rejected a power industry trade group’s petition to challenge New York state’s plan to reduce greenhouse gas emissions through the subsidization of nuclear power plants.

The Electric Power Supply Association claimed in a lawsuit that the New York Public Service Commission had violated federal law requiring power rates be “just and reasonable” when they elected to award $7 billion in rate increases through their zero emissions credit program.

After that argument was rejected by the Second Circuit Court of Appeals, the group applied to the Supreme Court for relief in January.
