Gov. Brian Sandoval’s office released a statement announcing the motion, saying in a statement the suit, filed by Texas, would “undercut Nevada’s opposition” to Yucca.

The Fifth Circuit Court of Appeals previously granted Nevada’s motion to intervene as a party in the lawsuit.

The governor’s office says the motion to dismiss, filed June 12, “is the first of several legal challenges” state officials, including Attorney General Adam Laxalt, plan to bring forward.

“Yucca Mountain would come at the direct expense of the health and safety of Nevadans and this petition would diminish Nevada’s ability to make its case against this ill-conceived project,” Sandoval said in a statement regarding Texas’s lawsuit.

The suit would require the Nuclear Regulator Commission to start and finish licensing proceedings for the Yucca site within a one-year time frame.

The motion filed by Nevada argues that Texas missed the 180-day window to bring civil action over the federal law that created Yucca in the 1980s.

The Silver State also argues that federal courts cannot force the White House to require a certain level of funding from Congress for the licensing process.

President Donald Trump has asked for $120 million in his 2018 budget to restart licensing at Yucca Mountain, a move that Sandoval, Laxalt and almost all members of Nevada’s Congressional delegation oppose.
