New England Coalition’s legal bid to shut down Vermont Yankee nuclear plant

This one comes from an anti-nuclear group known as the New England Coalition. The group asked the Vermont Supreme Court
to shut down the plant, saying the reactor’s owners agreed in 2002 to stop operating if they didn’t have a new certificate of public good by last March. Vermont Yankee still hasn’t received a new CPG.

The Shumlin administration says they’re watching this development closely, but choosing not to get involved at this point in time.

“We’ve also had our focus very much on the Public Service Board
proceeding because the federal District Court was very clear last year
that the Public Service Board retains jurisdiction to decide whether
to continue the operation of Vermont Yankee past this first CPG that
expired last March,” Vt. Public Service Commissioner Elizabeth Miller
said.

Miller says a request of this nature hasn’t been tried in Vermont
since the 1940s. Public Service Board proceedings on the future of the
plant continue in February.

It’s worth noting that Yankee might well have had that license in hand
before last March except that the PSB process was delayed by a federal
court case that Entergy ultimately won.
